MAHESHWARI & CO. has successfully represented Biotechnology Industry Research Assistance Council (BIRAC), which is a not-for-profit public sector enterprise, in a matter involving batches of writ petitions filed by various children suffering from a rare disease, namely, Duchenne muscular dystrophy (DMD).

The client is a not-for-profit Section 8, Schedule B, Public Sector Enterprise set up by the Department of Biotechnology (DBT), Government of India. 

In a matter of national importance, batches of writ petitions have been filed by various children suffering from a rare disease, namely Duchenne muscular dystrophy (DMD). The court has been hearing these matters from time to time and has issued various directions to enable treatment and make medicines available to the petitioners.

MAHESHWARI & CO. has successfully represented the public sector enterprise set up by the Government of India on a critical aspect of funding one of the private entities. Pursuant to the terms of the executed agreement, the private entity was liable to contribute 50%, but unfortunately, it failed to do so.

The court was pleased to acknowledge the limited role of the public sector enterprise and refrained from financially burdening it for the failure of the private entity.
